Participant Waiver & Assumption of Risk

1. Who This Waiver Applies To

This Waiver applies to every person ("Participant") who books, registers for, or participates in any adventure experience arranged through YaatraExpress, including but not limited to: Himalayan trekking, river rafting, paragliding, wildlife safaris, cycling tours, skiing, or any other activity offered on our platform.

If a Participant is under 18 years of age, their parent or legal guardian must confirm acceptance of this Waiver on their behalf. By confirming such a booking, the parent or guardian accepts full responsibility and assumes all risks on the minor's behalf.

2. Acknowledgment of Inherent Risks

I, the Participant, acknowledge and understand that adventure travel activities involve serious inherent risks that cannot be eliminated. These risks exist even when every reasonable precaution is taken. I am voluntarily participating in a YaatraExpress experience with full awareness of these risks. The risks include, but are not limited to:

2.1 High-Altitude Trekking Risks

• Acute Mountain Sickness (AMS), High Altitude Pulmonary Edema (HAPE), and High Altitude Cerebral Edema (HACE) — conditions that can be life-threatening if not treated promptly
• Falls on mountain terrain, snow, ice, scree, boulders, or steep slopes
• Hypothermia, frostbite, sunstroke, and dehydration
• Physical exhaustion beyond my anticipated capacity
• Avalanche, rockfall, and landslide
• Extreme cold, snowstorm, whiteout conditions, and sudden weather change
• Getting separated from the group or becoming disoriented
• Injury or death during summit attempts or high-altitude crossings
• Delays in evacuation due to remoteness and terrain
• Injury during road transport on mountain roads

2.2 River Rafting Risks

• Capsize, falling out of the raft, or being swept downstream
• Striking submerged rocks, hydraulics, or river structures
• Entrapment under the raft or in swift water
• Drowning, even for swimmers or persons wearing a life jacket
• Injury from paddle contact, raft impact, or cliff jumping
• Rapidly rising water levels or flash floods

2.3 Paragliding Risks

• Hard or uncontrolled landing
• Equipment malfunction despite pre-flight checks
• Sudden turbulence, wind shear, or thermal collapse
• Collision with terrain, trees, or structures
• Injury or death during takeoff, flight, or landing

2.4 Wildlife Safari Risks

• Encounter with wild animals including tigers, elephants, crocodiles, and other fauna
• Insect bites, vector-borne illness, and allergic reactions
• Boat capsize in mangrove or river environments
• Vehicle breakdown in remote forest areas

2.5 General Risks Applicable to All Experiences

• Physical injury of any kind including fractures, sprains, lacerations, and head injuries
• Aggravation of pre-existing medical conditions
• Cardiac events triggered by physical exertion at altitude
• Illness from food, water, or environmental exposure
• Permanent disability or death
• Loss or damage to personal property and equipment
• Acts of God, natural disaster, or force majeure events beyond anyone's control

3. Voluntary Assumption of Risk

I confirm that my participation in any YaatraExpress experience is entirely voluntary. I have been given adequate opportunity to review these risks, ask questions, and seek independent advice. Having considered these risks, I freely and voluntarily choose to participate and I accept full personal responsibility for any injury, illness, loss, damage, or death that may result from my participation — including those arising from conditions inherent in the activity and from any act, omission, or negligence of YaatraExpress, its Service Providers, trek leaders, guides, or other participants, to the fullest extent permitted by applicable law.

4. Medical Fitness Declaration

By confirming a booking, I declare that:

• I am in good physical health and have adequately prepared for the physical demands of the experience I am booking.
• I am not aware of any medical condition, physical limitation, or medication that would make my participation unsafe, or I have obtained a qualified medical practitioner's clearance and disclosed all relevant information to YaatraExpress in writing prior to departure.
• I will disclose all relevant medical information — including cardiac conditions, respiratory conditions, diabetes, epilepsy, blood pressure disorders, allergies, current medications, and any history of altitude sickness — to the trek leader before the experience commences.
• I am not pregnant, or if pregnant, I have received express medical clearance from a qualified doctor and have disclosed this to YaatraExpress.
• I understand that high-altitude environments (above 8,000 ft) can precipitate or aggravate medical conditions that were previously controlled or asymptomatic.
• I accept full responsibility for any consequences arising from my failure to disclose relevant medical information.

5. Indemnification

To the fullest extent permitted by applicable Indian law, I agree to indemnify, defend, and hold harmless YaatraExpress, its officers, employees, contractors, Service Providers, trek leaders, guides, and agents from and against any and all claims, demands, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or connected with: (a) my participation in any YaatraExpress experience; (b) my breach of any of these Terms or this Waiver; (c) my negligence or wilful misconduct; or (d) any claim brought by a third party arising from actions I took during an experience.

6. Emergency Medical Treatment Authorisation

In the event that I am incapacitated, unconscious, or otherwise unable to make decisions, I authorise YaatraExpress and/or the trek leader or Service Provider to: (a) contact emergency services on my behalf; (b) consent to emergency medical treatment that the attending medical professional deems necessary to preserve my life or prevent serious injury; and (c) share my personal and medical information with emergency services, hospitals, and relevant authorities as required. I understand and accept that I am responsible for all costs incurred as a result of such emergency treatment and evacuation.

7. Safety Instructions

I agree to follow all safety briefings, instructions, and directions given by trek leaders, guides, and Service Providers at all times during the experience. I understand that failure to comply with safety instructions may endanger my own safety and that of others, and may result in my removal from the experience without refund. I will not undertake any activity or venture beyond the designated area without the express permission of the trek leader.

8. Travel Insurance

I understand and accept that it is my sole responsibility to obtain comprehensive travel insurance that covers, at minimum: emergency medical treatment, emergency helicopter evacuation and rescue, high-altitude related illness, trip cancellation or interruption, personal accident including death and permanent disability, and personal liability. I confirm that I have obtained or will obtain such insurance before my Departure Date. I acknowledge that YaatraExpress does not provide insurance and cannot be held responsible for any costs that should have been covered by insurance.

9. Summit and Activity Completion — No Guarantee

I understand that completion of any summit, route, rapid, or activity component is not guaranteed. Decisions regarding whether to proceed, modify, or abort any component of an experience rest entirely with the trek leader or guide on the basis of weather conditions, trail conditions, group fitness, and safety considerations at the time. I accept that such decisions are made in the interest of participant welfare and I will not hold YaatraExpress or any Service Provider liable for inability to complete any stated activity.

10. Governing Law

This Waiver is governed by the laws of India. Any dispute arising under this Waiver shall be resolved in accordance with the dispute resolution provisions set out in the YaatraExpress Terms & Conditions.
